SPIRG building permit appeal unsuccessful

A Superior Court Justice has upheld the Township of Southgate decision to issue a building permit to Lystek for the innovative biosolid processing facility the company is building in the Southgate Eco Park.

“This is a great decision for the township and the Eco Park,” said Mayor Brian Milne. “The Lystek building permit was issued after detailed due diligence and a complete review by the township. The court has recognized that our process and decisions were legal and appropriate.”

The key points from the 54-page ruling are:

• The Court agreed that the township was correct to consider Lystek a “dry industry” and that they issued the original permit appropriately;

• The Court concluded that the M1 zone, where the Eco Park is located, requires that all park tenants be connected to municipal water and sewer services; and

• Accordingly, the Court ordered that the building permit be amended to require the Lystek facility be connected to the township’s municipal water and sewer services before any temporary or permanent occupancy. Prior to the court’s decision,

The township and Lystek had already offered this as a solution and say they are happy to comply.

Still to be determined is the issue of court costs which, in Canada, are normally paid by the losing party to the winning side.

“We appreciate all the time and hard work that all parties have put into this process and are obviously very pleased with this decision,” said Kevin Litwiller, Director of Business Development for Lystek. “Lystek is proud of to be part of the Eco Park and will continue moving forward with our economic and environmentally responsible project.”
